He came from behind? Where does it say that? I looked over it several times and just said "grabbed the officers neck" and threatened to punch him in the face, doesn't sound from behind to me. I mean I could be reading it wrong, but pretty sure it wasn't from behind.
Doesn't matter the age or what. My grandfather is 80, and he's more than capable of choking a cop and taking his gun.
so, if alcohol was present and he approached the officer in any manner.... he had the right to defend himself... Age plays a part in how easy it is for the elder to receive injury.
The words 'elderly' and 'senior' tend to conjure images of weakness. This is just word spinning.
The status of being a senior citizen doesn't give them a free pass to assault anyone.
We cant pity them if they're breaking the law just because they're considered elderly.
And being elderly doesn't mean they're weak. I'm sure most of us know some tough older folks that we wouldn't want to mess with. My own grandmother, up until she was 86 or so and broke her hip, was a very strong woman who tilled and hoed her own gardens and did a good deal of the manual labor around her home.
FWIW Younger folks are also injured in altercations with police.

I know a man (as im sure others do on this board) who is in his 80's and still transports prisoners for the county. he carries his 44 magnum proudly and tells everyone of them that he is an old man, will beat their ass, and isnt afraid to blow their heads off he needs to. puts on his seatbelt, and drives on. haha if i could remember his name i would gladly post it. he hangs out down at big bore a lot.

You read too much into my post. I didn't say it was this particular situation, but a general situation of being in a cops shoes. We really don't know the angle the attacker came one way or the other, but I assume its at least from the side since he grabbed the cops arm.
